A recent and very lengthy report from Stan Sohler, Executive Editor of Sun Era,
Inc., includes the information that in February, 1965, a Superior
Court Judge dismissed all charges involving these magazines. This
follows other court rulings in various locations in the United States
that nudist magazines, per se, are not obscene.
In March, the Federal Grand Jury at Fort Dodge, Iowa, handed down a series of indictments charging various individuals with conspiring to place obscene material in the United States mail. With some minor exceptions, the entire list of publications and individuals was identical with the Los Angeles indictments which have been dismissed.
There is little doubt that these indictments will also be dismissed eventually, but there may be a lenghty and costly trial before the case is finally won.
Thinking people agree that the attack on the Sun Era publications is part of a campaign against nudism. If Sun Era and Milt Luros were not strong enough to fight right through Appeal Courts to the Supreme Court of the United States, if necessary, there is little doubt that all other nudist magazine publishers would eventually find themselves under attack. From there it seems obvious that the next move would be an all-out frontal attack on nudist clubs and nudist associations throughout the United States. The price of freedom is eternal vigilance.
